1. Acceptance of Terms
By accessing or using the Travyol website or mobile application (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Travyol Inc. (“Travyol”, “we”, “us”, or “our”).
2. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use Travyol. By using the Service, you represent that you meet this requirement. If you are using Travyol on behalf of a business, you represent that you have the authority to bind that business to these Terms.
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password and accept responsibility for all activity under your account.
- Notify us immediately at info@travyol.com if you suspect unauthorised access to your account.
- Not share your account credentials with any third party.
4. The Service
4.1 Description
Travyol provides AI-powered tools to generate travel itineraries, browse community-shared trips, and plan solo travel experiences. The AI-generated content is for informational and planning purposes only.
4.2 Important Disclaimer on Itineraries
AI-generated itineraries are suggestions based on the information you provide. Travyol does not guarantee the accuracy, completeness, safety, or suitability of any suggested destination, activity, accommodation, or route. You are solely responsible for:
- Verifying travel advisories, visa requirements, and entry conditions.
- Assessing the safety of destinations and activities.
- Booking and confirming all travel arrangements independently.
- Obtaining adequate travel insurance for your trip.
4.3 Service Availability
We strive for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.
5. User Content
You may share trip plans, reviews, and other content on Travyol (“User Content”). By submitting User Content, you:
- Retain ownership of your content.
- Grant Travyol a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display the content to operate and improve the Service.
- Represent that you own or have the right to share the content and that it does not infringe any third-party rights.
You must not post content that is:
- Unlawful, harmful, threatening, abusive, or defamatory.
- Misleading, false, or constitutes spam.
- An infringement of intellectual property rights.
- Containing malware, viruses, or malicious code.
6. Intellectual Property
All content, software, designs, trademarks, and intellectual property on the Travyol platform (excluding User Content) are owned by or licensed to Travyol Inc. You may not copy, reproduce, distribute, or create derivative works without our express written permission.
7. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to reverse engineer, decompile, or extract source code from the Service.
- Scrape, crawl, or systematically extract data from the platform without prior written consent.
- Use the Service to generate content that violates any third party’s rights or applicable laws.
- Impersonate any person or entity or misrepresent your affiliation.
- Interfere with or disrupt the integrity or performance of the Service.
8. Subscriptions and Payments
Travyol offers free and premium subscription tiers. Premium subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law or as stated in our refund policy. You may cancel your subscription at any time; access will continue until the end of the current billing period.
9. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TRAVYOL DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL TRAVYOL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TRAVYOL IN THE PAST 12 MONTHS.
10. Indemnification
You agree to indemnify and hold Travyol Inc. and its officers, directors, employees, and agents harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.
11. Termination
We reserve the right to suspend or terminate your account and access to the Service at our discretion, with or without notice, if you violate these Terms. You may also delete your account at any time through the app settings. Upon termination, your licence to use the Service ceases immediately.
12. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall first be addressed through good faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated with at least 14 days’ notice via email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
